Circuit Judge Linda Babb yesterday dismissed a lawsuit by Angelo's Aggregate Materials over plans to build a landfill a rural section outside of Tampa, Florida.
The family that owns the 1,000-acre property that would hold the proposed landfill argued that the county specifically changed its comprehensive plan prevent the construction of the landfill.
Judge Babb ruled that Angelo's couldn't sue the county for denying a rezoning for the landfill until county commissioners actually voted against the landfill. It is expected that the lawsuit will be re-filed at that time.
Regardless, Angelo's faces an uphill battle. In January, Florida Department of Environmental Protection upheld the state's decision to reject a landfill permit. Without it, it is unlikely the landfill will be built..
The landfill was first proposed in 2006. It has come under fire by opponents who fear the site would contaminate local rivers and reach the city's water supply.
