The FDEP alleges that the operator broke environmental laws through a failure to contain foul odors, accepting unauthorized waste and exceeding the landfill's permitted dimensions. In addition, the company is also accused of not providing adequate financial assurance, contaminating surface water and failing to implement a remedial action plan to take care of the contamination.
A potential class-action suit may be in the works. About 200 residents have stepped forward top obtain legal counsel against numerous landfill operators in the area.
